App. Div. 3d Dep't 2011) <br />NEW YORK (11/03/11)—This case addressed the issue of whether a <br />town's alleged failure to act on a special permit application within a reason- <br />able period of time resulted in the application being approved by default. <br />The Background/Facts: In 2004, Troy Sand & Gravel Company, <br />Inc. ( "Troy ") planned to establish a quarry in the Town of Nassau (the <br />"Town"). In furtherance of those plans, Troy submitted to the Town appli- <br />cations for a special permit and site plan approval for the quarry. <br />After the town passed successive moratoria on new mining applications, <br />in 2008, the Town passed a zoning law that permanently banned commer- <br />cial excavation. <br />Troy subsequently sued the Town. It asserted that the Town's actions <br />were taken in bad faith to prevent the operation of the proposed quarry. It <br />argued the Town's failure to act in a reasonable period of time on its spe- <br />cial use permit application rendered the application approved by default.
