Ct. 2011) <br />PENNSYLVANIA (11/18/11)—This case addressed the issue of whether a <br />landowner had proven unnecessary hardship so as to obtain a use variance. <br />The B ackground/Facts: Oxford Corporation ( "Landowner ") owned a <br />10.5 -acre parcel of property in the borough of Oxford (the "Borough"). <br />The parcel was zoned industrial. Landowner sought to develop the prop- <br />erty as a residential use, which was not a permitted use in the industrial <br />zone. Landowner filed an application with the Borough's Zoning Hearing <br />Board (the "Board ") to obtain a use variance for a residential use. In seek- <br />ing the variance, Landowner alleged that the property could not be used <br />"in any reasonable or economically viable manner as currently zoned." <br />The Board denied Landowner's request. The Board concluded that <br />Landowner failed to demonstrate by substantial evidence that it was en- <br />titled to any variance relief.
