Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. The Commission recessed at 9:18 p.m. Chairman Zimmerman called the regular meeting back to order at 9:40 p.m. Motion by Commissioner Bawden and seconded by Commissioner Deemer to amend Item #27 of the Proposed Findings of Fact to indicate that the proposed use will substantially adversely impair the use, enjoyment or market value of surrounding property. Motion carried. Voting Yes: Commissioners LaDue, Bawden and Deemer. Voting No: Chairman Zimmerman and Commissioner Terry. Absent: Commissioners Hendriksen and Thorud. Motion by Commissioner Deemer and seconded by Commissioner Terry to delete Item #28 of the proposed Findings of Fact, as it was a repeat of Item #27. Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. Motion by Commissioner Deemer and seconded by Commissioner Bawden to amend Item #29 of the proposed Findings of Fact to indicate that the proposed use will not be harmonious with the comprehensive plan. Further Discussion. Chairman Zimmerman questioned how the City could grant a conditional use permit for a particular use and then not allow an expansion of the same use. Commissioner Deemer stated that facts have changed since the original CUP was issued and the use as it exists now is not in conformance with the comprehensive plan. Commissioner Terry noted that the conditional use permit is referring to the use and not to the operation. Mr. Otto noted that in the original conditional use permit, the findings indicated that the proposed use will be harmonious with the comprehensive plan. Commissioner Deemer noted that when the original conditional use permit was considered, the City was not informed that Mr. Karst would be disassembling and storing buses on adjacent property. Mr. Otto noted that the proposed amended conditional use permit also does not include storage of buses; the storage of feed stock on adjacent property would be addressed under a new conditional use permit and site plan. In the meantime, Lots #2 and #3 were not included in the original conditional use permit, therefore, Mr. Karst is in violation of the ordinance regarding screening for uses that occur in an industrial zone. Mr. Karst stated that as he understands the situation, he has three options for Lots #2, #3 and #4: 1) apply to the City for a conditional use permit and site plan approval; 2) screen the buses; or 3) remove the buses. Commissioners Deemer and Bawden withdrew their motion. Motion by Commissioner LaDue and seconded by Commissioner Terry to amend Item #29 of the proposed Findings of Fact to indicate that the proposed use will be harmonious with the comprehensive plan.
