City Council adopt the Findings of Fact as amended relating to Mr. Daniel Karst's request for a <br />conditional use permit to expand an aluminum recovery and processing business. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Mr. Karst stated that all he is really requesting is to be able to install a second furnace in his <br />operation, to keep inventory at a minimum and modify the furnaces to operate with afterburners to <br />solve odor and emission problems. Mr. Karst added that recycling is important to the society and <br />to not try every means to keep things out of landfills is a step backward. <br /> <br />Sharon Watson stated that her client is attempting to work with the City to solve issues and in <br />doing so, he has invested $100,000.00 to date on Lot #1 and proposing to invest another <br />$25,000.00 for the installation of afterburners. Ms. Watson asked that the City not deny Mr. <br />Karst's application for an amended conditional use permit as the intent of the amendment is to <br />address some of the problems that have been raised under the existing conditional use permit. <br /> <br />Commissioner Deemer stated that if the request were to be denied, it would basically be denying <br />the start up of a second furnace and not an improvement to the existing furnace by the addition of <br />an afterburner. Commissioner Deemer also stated that in his opinion, the existing furnace should <br />be improved with the addition of an afterburner to prove that it will control smoke and odor before <br />the City considers expanding the operation to two furnaces. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Terry that, based on the <br />Findings of Fact, the Planning and Zoning Commission concludes that the proposed use does <br />comply with the requirements of the City Code, Sections 170.013D and accordingly recommends <br />approval of the application for a conditional use permit by Danny's Aluminum Processing, Inc. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue and Terry. Voting <br />No: Commissioners Deemer and Bawden. Absent: Commissioners Hendriksen and Thorud. <br /> <br />Commissioner LaDue stated that operation of an aluminum processing facility is a learning <br />experience for both the City and the applicant and also that the City approved the use when it <br />approved the original conditional use permit. The City owes it to him and the public to make every <br />attempt to make it work. <br /> <br />Chairman Zimmerman stated that it would not be appropriate to approve a conditional use permit, <br />let the owner invest $100,000.00 in improving the site and then shut him down. <br /> <br />Commissioner LaDue noted that the City also has to depend on City staff to control complaints and <br />violations. <br /> <br />Motion by Chairman Zimmerman and seconded by Commissioner LaDue to indicate that any time <br />there is an incident report filed regarding Danny's Aluminum Processing, the applicant will be <br />notified immediately, regardless of the time of day, in order that he may take immediate action to <br />correct the problem. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners LaDue, Bawden, Deemer <br />and Terry. Voting No: None.
