CC Regular Session 4. 5. <br />Meeting Date: 02/14/2012 <br />By: Brian Olson, Engineering/Public Works <br />Information <br />Title: <br />Consider Approval of Easements Necessary for the Ramsey Rail Station <br />Background: <br />On 09/27/2011, the City Council approved the Master Cooperation, Funding and Delegation Agreement contingent <br />upon successful negotiation of the transit taxing district and lease agreements subject to the review and approval of <br />the City Administrator and City Attorney. <br />On December 13, 2011, the City Council agreed to the terms of the Master Cooperation, Funding and Delegation <br />Agreement which included terms for constructing and operating the Ramsey Rail Station. <br />Notification: <br />Observations: <br />The Master Cooperation, Funding and Delegation Agreement relegated the responsibility of securing the land south <br />of the BNSF right of way for the rail station to the City of Ramsey. Since we already owned this land (old Wilson <br />property)and it was acquired through the RALF program, the City was required to ammend the RALF loan <br />agreement to transfer the rights to this property without any cost implications. On October 11, 2011, the City <br />Council approved such an ammendment to the loan agreement. <br />Attached to this case is the permanent easement necessary to fully operate the rail station. This easement will be <br />coupled with a right of entry agreement that allow access to the entire parcel for construction and staging. The right <br />of entry agreement is being prepare by the Metropolitan Council and was not available as of the writing of this <br />case.
