Background:

c sz #

Airport Zoning

On October 13, 1987, the City Council adopted an Airport Land Use
Safety Zoning Ordinance. This was subsequently brought to a
referendum election and was defeated. The Ordinance was, thus, not
placed into effect. An opinion was sought from the Attorney
General's office regarding the effect of the election on the
Ordinance. That opinion was received December 20, 1989 and in
essence sustained the public's right to approve or void a land use
(legislative) ordinance. A copy of the opinion is attached.

We transmitted a copy of the AG's opinion to Mn/DOT on December 21,
1989 and requested several clarifications or responses from them
regarding 1) the impact on an airport project, 2) commissioner's
inclination to place airport zoning in effect if requested to do
so, 3) whether this would jeopardize funding or cost sharing on the
airport. We anticipate a response from them by January 23.

My memo of April 22, 1988 (attached) outlined options available to
the City regarding implementation of airport zoning. Options 1,
2 and 5 are no longer valid as a result of the AG's opinion.

Consider Initiating Airport Improvement Program

Jack Ippel and I met with FAA, Mn/~DOT and MA~ on , 1989 to
ascertain the various agencies' commitment to the airport
improvement project. Discussion at this meeting indicated that
federal funding would not be available for airport improvements
until at least October 1, 1991 or 1992 (federal FY 1992 or 1993).
FAA's position has consistently been that no federal funds would
be allocated for the project until such time that landfill
activities cease.

As a result of the earlier meeting, Mn/DOT requested a meeting.
On December 20, Jack Ippel and I met with Mn/DOT officials to
discuss the status of the airport project with them.

·
We reviewed the overall situation regardlng:.~
/

1)
2)
3)

5)

status of plan approvals
status of airport zoning
status of existing landfill operations
status of Site P selection
Possible staging concepts for acquisition to permit initial
state/local funding with future AIP reimbursement.

Mn/DOT indicated at that meeting that they would be willing to
proceed with an acquisition program with a first phase of
approximately one million dollars. This, however, is conditioned
on the city: 1) committing to a one-third cost share for Phase I,
2) reviewing and, if feasible, planning for a crosswind runway.
