miles of the Gateway North Industrial Airport? <br /> <br />A majority of those persons voting at~ the special election voted <br />"No" on the above question, and therefore, pursuant to the City <br />Charter, Ordinance 87-7, was not allowed to take effect. A copy <br />of Ramsey City Charter Chapter 5 is attached for your review. <br /> <br /> Minn. Stat. 360.061 et. seq. (Airport Zoning) provides the <br />means by which a municipality may abate airport hazards which <br />endanger "the lives and property of users of the airport and of <br />occupants of land in its vicinity..."-(Minn. Stat. 360.062). The <br />City continues to have a private airport within its territorial <br />limits but because of the above described charter referendum, has <br />been unable to abate airport hazards. Therefore, the City is <br />requesting your opinion on the following two questions: <br /> <br />QUESTION ONE <br /> <br /> Notwithstanding the City Charter authorized referendum denYing <br />the adoption of Ordinance 87-7, may the Ramsey city Council under <br />the authority of Minn. Stat. 360.061 et. seq. and specifically <br />Minn. Stat. 360.063, Subd. 1, adopt zoning regulations similar to <br />those found in Ordinance 87-7 in order to prevent the creation or <br />establishment of airport hazards which could affect the use of <br />Gateway North Industrial Airport? <br /> <br />QUESTION TWO <br /> <br /> Notwithstanding the city Charter authorized referendum denying <br />the adoption of Ordinance 87-7, may the Ramsey city Council under <br />the authority of Minn.
