It was explained that the existing
facility is situated 85 feet from the centerline of Sunfish Lake Boulevard. The required setback
from Sunfish Lake Boulevard is 110 feet. The deficiency was a result of County improvements to
Sunfish Lake Boulevard after the construction of the Mate Punch and Die facility. At this time,
Mate Punch and Die is proposing to expand their facility with an extension of the dimensions of the
existing structure. The expansion would also encroach the Sunfish Lake Boulevard setback. The
applicants noted that the legal description in the proposed Findings of Fact is not totally accurate.

Sylvia Frolik also noted that the existing Mate Punch and Die facility encroaches by 20 feet the 110
foot setback requirement from Industry Avenue. This is also a result of the County upgrading
Industry Avenue following the construction of the Mate Punch and Die facility. Sylvia Frolik
stated that it would be in the best interest of Mate Punch and Die if a variance to the existing
encroachment on Industry Avenue was also documented in the variance.

Motion by Commissioner Deemer and seconded by Commissioner Zimmerman to adopt Findings
of Fact//0278 relating to Mate Punch and Die's request for a variance from thoroughfare setback
requirements with the legal description amended accordingly.

Motion carded.
