It was noted that
Dorothy Schleper owns land that is necessary for the extension of 153rd Avenue N.W. The
acquisition of the necessary right-of-way will require relocation of the Schleper home on the
property. The dwelling relocation plans include fronting the home on 153rd and to do so will
require a variance from front yard setback requirements.

The Commission proceeded to review the proposed Findings of Fact.

Commissioner Deemer noted that the proposed Findings of Fact indicate that the required setback
is 40'. Commissioner Deemer explained that he believes 153rd Avenue N.W. qualifies as a
thoroughfare and therefore, the required setback should be 50' from the front property line.

Motion by Commissioner Deemer and seconded by Commissioner Bawden to direct City staff to
research whether or not thoroughfare setbacks apply to 153rd Avenue N.W. and if necessary,
amend Item #8 of the proposed Findings of Fact accordingly.

Motion carried. Voting Yes: Chairman Hendriksen, Commissioners LaDue, Deemer, Terry,
Thorud and Bawden. Voting No: None. Absent: Chairman Zimmerman.

Motion by Commissioner Hendriksen and seconded by Commissioner Deemer to add an item to
the proposed Findings of Fact to indicate that the existing metal shed on the subject property is
currently used for housing livestock and is located approximately 20 feet from the property line and
that City Code requires that there be a 75' setback from property lines for structures housing
livestock. Further, that the location of the metal shed on the subject property is a pre-existing, non-
conforming use.

Motion carried. Voting Yes: Chairman Hendriksen, Commissioners LaDue, Deemer, Terry,
Thorud and Bawden. Voting No: None. Absent: Chairman Zimmerman.

Motion by Commissioner Deemer and seconded by Commissioner to adopt Findings of Fact
#0282 relating to Dorothy Schleper's request for a variance from front yard setback requirements.

Board of Adjustment/November 7, 1990
