DRAFT <br />610 — COUNTY CLOSED LANDFILL RESTRICTED (CLR) <br />The Closed Landfill Restricted (CLR) District is intended to apply to the former Winona County <br />Landfill which is qualified to be under the Closed Landfill Program of the Minnesota <br />Pollution Control Agency (MPCA). <br />610.1 Purpose <br />The purpose of the district is to limit uses of land within the closed landfill, both actively filled <br />and related lands, to minimal uses in order to protect the land from human activity where <br />response action systems are in place and, at the same time, are protective of human health <br />and safety. This district shall only apply to the closed landfill's Land Management Area, <br />the limits of which are defined by the MPCA. This district shall apply whether the <br />landfill is in public (MPCA, County, City, Township), Indian tribal, or private ownership. <br />The location of this landfill is described by: <br />That part of the Southwest quarter of Section 10 and that part of the Southeast quarter of Section <br />9, all in Township 106 North, Range 7 West, Winona County, Minnesota, described as <br />follows: <br />Commencing at a county monument found at the West quarter corner to Section 10; thence <br />South 00 Degrees 03 Minutes 07 Seconds West (NAD 83 Winona County Coordinate <br />System, 1996 Adjustment), along the West line of said Southwest quarter, a distance of <br />172.50 Feet to a found %" pipe at the Point of Beginning of the land to be described; <br />thence South 81 Degrees 21 Minutes 04 Seconds East, a distance of 409.89 Feet to a set <br />5/8" rebar with aluminum cap, thence South 41 Degrees 26 Minutes 43 Seconds East, a <br />distance of 1042.69 Feet to a set 5/8" rebar with aluminum cap; thence South 27 Degrees <br />26 Minutes 53 Seconds West, a distance of 500.24 Feet to a set 5/8" rebar with aluminum <br />cap; thence South 67 Degrees 13 Minutes 45 Seconds West, a distance of 531.83 Feet to <br />a set 5/8" rebar with aluminum cap; thence Westerly 346.88 Feet along a tangential curve <br />concave to the North, central angle of 42 Degrees 50 Minutes 01 Seconds, with a radius <br />of 464.00 Feet to a set 5/8" rebar with aluminum cap; thence North 69 Degrees 56 <br />Minutes 14 Seconds West, a distance of 497.25 Feet to a set 5/8" rebar with aluminum <br />cap; thence South 50 Degrees 39 Minutes 25 Seconds West a distance of 271.18 Feet to a <br />found %" pipe; thence South 82 Degrees 15 Minutes 44 Seconds West, a distance of <br />154.01 Feet to a found 3 /4" pipe; thence Southwesterly 157.75 Feet along a tangential <br />curve concave to the Southeast, central angle of 54 Degrees 26 Minutes 58 Seconds, <br />radius 166.00 Feet to a found %" pipe; thence South 27 Degrees 48 Minutes 46 Seconds <br />West, a distance of 71.43 Feet to a found 3 /4" pipe; thence Westerly 206.08 Feet along a <br />tangential curve concave to the North, central angle of 135 Degrees 09 Minutes 37 <br />Seconds, radius 8736 Feet to a found 3/4' pipe; thence North 17 Degrees 01 Minutes 37 <br />21 September 2010 Page 1 <br />
