App. 4th 339, 2011 WL <br />5966277 (6th Dist. 2011) <br />CALIFORNIA (11/30/11)—This case addresses the issue of whether the <br />doctrine of exhaustion of administrative remedies applies and precludes ju- <br />dicial relief in a case where medical marijuana dispensary operators chal- <br />lenged nuisance abatement orders issued by the county. <br />The Background/Facts: San Jose Cannabis Buyer's Collective, LLC <br />("SJCBC") and Pharmer's Health Center Cooperative, Inc. ( "Pharmer's ") <br />(collectively, the "Dispensaries") leased buildings in the city of San Jose from <br />which they operated medical marijuana dispensaries. In January 2010, the <br />San Jose Department of Planning and Code Enforcement (the "Department") <br />issued nuisance abatement compliance orders to the Dispensaries.
