Town of Madison Planning Bd., 2011 TL 6188621 <br />(N. -I. 2011) <br />NEW HAMPSHIRE (12/08/11)—This case addressed the issue of <br />whether a public body's closed session to discuss the written advice of <br />counsel who is absent fits within the "consultation with legal counsel" <br />exclusion of New Hampshire's Right -to -Know Law, RSA 91 -A:2, I(b). <br />The BackgroundlFacts: The Pomeroy Limited Partnership ("Pome- <br />roy") owned property in the town of Madison, New Hampshire. Pome- <br />roy sought to covert buildings on the property to a condominium own <br />ership form.
