119. The City of Ramsey violated notice legal requirements in conducting the <br />abatement. <br />120. Defendant Kurtis Ulrich, as City Administrator, failed to ensure the City of <br />Ramsey provided due process to Kiefer by failing to provide timely specific notice prior to the <br />October 2007 abatement. <br />121. The Defendants have failed and refuse to compensate Kiefer for property taken <br />from him. <br />122. Because of the failure of the Defendants to lawfully conduct its abatement, in <br />violation of the Due Process Clause, Kiefer has been damaged in an amount exceeding $50,000. <br />123. Kiefer has been damaged due to the City of Ramsey's violation of federal <br />Constitution's Due Process Clause. <br />124. Kiefer also request all remedies available under 42 U.S.C. § 1983 including <br />damages and attorney's fees and all other relief the court deems just. <br />COUNT VIII <br />42 U.S.C. § 1983 CIVIL RIGHTS CLAIM — <br />UNCOMPENSATED TAKING OF PERSONAL AND COMMERCIAL PROPERTY <br />125. Paragraphs 1 through 124 are restated by reference. <br />126. The United States Constitution, Amend. V, guarantees all persons the right to just <br />compensation if their private property is taken by the government. <br />127. Federal law, under 42 U.S.C. § 1983, provides remedies for violations of civil <br />rights. <br />128. Kiefer owned the personal property which was taken by the City of Ramsey and <br />its agent during the October 2007 abatement. <br />20 <br />
