Third Party Defendants. <br />2. Third Party Defendant City of Ramsey, Minnesota is a municipality in Minnesota. <br />3. Third Party Defendant Kurtis Ulrich is the City Administrator for the City of <br />Ramsey, Minnesota. <br />Factual Background <br />4. The City of Ramsey started two civil proceedings against Plaintiff without the <br />City of Ramsey's proceedings being grounded in law and fact. <br />5. Both of the lawsuits were eventually dismissed. <br />6. In the beginning, the City of Ramsey cited Keith Kiefer for nuisance on August <br />25, 2005 under its City Code § 5.12.01, a misdemeanor offense. The City alleged that Kiefer had <br />"junk vehicles" on his property. <br />7. Under § 5.12.01a, the definition of "junk automobiles" is specific: <br />[T]he term "junk automobiles" shall include any motor vehicle, part of a motor <br />vehicle or former motor vehicle, stored in the open, that is either: <br />1. unusable or inoperable because of lack of, or defects in, component parts; <br />or <br />2. unusable or inoperable because of damage from collision, deterioration, or <br />having been cannibalized; or <br />3. beyond repair and, therefore, not intended for future use as a motor <br />vehicle; or <br />4. being retained on the, property for possible use of salvageable parts. <br />8. The City of Ramsey Code states under § 5.01.02 that "[a]ny violation of this <br />Chapter [5] is a misdemeanor...." <br />9. In addition, under City Code § 5.01.01, it specifically lists Minn. Stat. § 609.745: <br />
