PLANNING AND ZONING COMMISSION <br />PUBLIC HEARING <br /> CITY OF RAMSEY <br /> ANOKA COUNTY <br /> STATE OF MINNESOTA <br /> <br />The Planning and Zoning Commission conducted a public hearing on Tuesday, September 5, 1989 <br />at the Ramsey Municipal Center, 15153 Nowthen Blvd. N.W., Ramsey, Minnesota regarding the <br />proposed amendment to the Zoning Ordinance regarding waste incineration. <br /> <br />Members Present: <br /> <br />Mr. Gerald Zimmerman, Chairman <br />Mr. David Bawden <br />Mr. Terry Hendriksen <br />Mr. Charles LaDue <br />Mr. Ben Deemer <br />Mr. Michael Terry <br />Mr. Roy Shumway <br /> <br />Also Present: <br /> <br />Community Development Director Mark Banwart <br />Mr. Mefland Otto/Hakanson Anderson Associates <br /> <br />CALL TO ORDER <br /> <br />Chairman Zimmerman called the public hearing to order at 7:31 p.m. <br /> <br />CITIZEN INPUT <br /> <br />Sharon Dahlgren - 6328 143rd Lane - Inquired if the proposed ordinance will prohibit incineration <br />in Ramsey. <br /> <br />Mr. Otto replied that in the opinion of the City Attorney, the proposed ordinance would first and <br />foremost prohibit any incineration on a contract commercial basis but it is doubtful that it could <br />stand a challenge in court. The ordinance as proposed may serve to dissuade a proposed facility <br />but if the applicant were serious about locating in Ramsey, the ordinance would probably not hold <br />up in court. The alternative to the ordinance proposed is a very technical document which was <br />rejected as it was determined to be a better choice to have a broad based ordinance in addition to <br />Federal and State guidelines drafted by persons with the expertise necessary. All incinerators <br />would also be required to go through the conditional use permit process, thereby giving the City an <br />opportunity for more detailed control of a facility than is given by the ordinance. <br /> <br />Sharon Dahlgren - Inquired as to how this proposed ordinances affects the use of incinerators like <br />those operated at Ramsey School, LeTourneaus Super Value, restaurants, etc. <br /> <br />Mr. Otto stated that the proposed ordinance specifically addresses solid waste as well as hazardous <br />waste. The ordinance states that no burning of solid, hazardous, medical or special waste shall be <br />allowed within the City either as a permitted use or a conditional use permit. <br /> <br />Thomas Williams - 5180 157th Lane N.W. - Noted that the proposed ordinance drafted by a group <br />of citizens and submitted with a petition for referendum many months ago was determined by City <br />Staff to be indefensible and the consensus was that the City would not spend money defending it if <br />it were challenged in court.
