Motion by Commissioner Bawden and seconded by Commissioner LaDue to amend Item <br />#9 of the proposed findings of fact to indicate that the apartment would be used to <br />accommodate 'a visiting minister' versus 'visiting ministers and church officials'. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Terry, Deemer, <br />Bawden, LaDue and Shumway. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Terry to amend Item <br />#15 to indicate that the proposed use is not in accordance with the objectives of the <br />Comprehensive Plan. <br /> <br />Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Terry, Deemer, <br />Bawden, LaDue and Shumway. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Motion by Commissioner LaDue and seconded by Commissioner Shumway to amend the <br />proposed findings of fact and add Item #22 indicating that the Commission received a letter <br />from Joseph and Mary Jo Sentyrz dated October 3, 1989 stating their opposition to the <br />request. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Terry, Deemer, <br />Bawden, LaDue and Shumway. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Shumway and seconded by Commissioner Bawden to <br />recommend that City Council adopt the proposed findings of fact relating to Jehovah <br />Witness Kingdom Hall's request for a conditional use permit amendment to have an <br />apartment in the church. <br /> <br />Motion carried. Voting Yes: Chairman Zimmerman, Commissioners Terry, Deemer, <br />Bawden, LaDue and Shumway. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />The Commission proceeded to review the proposed conditional use permit. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner LaDue to amend Item <br />#6 of the proposed conditional use permit to indicate that the apartment would be used a <br />maximum of 18 weeks versus 20 weeks a year. <br /> <br />Motion carded. Voting Yes: Chairman Zimmerman, Commissioners Terry, Deemer, <br />Bawden, LaDue and Shumway. Voting No: None. Absent: Commissioner Hendriksen. <br /> <br />Motion by Commissioner Bawden and seconded by Commissioner LaDue to recommend <br />that City Council approve the Jehovah Witness Kingdom Hall's request for a conditional <br />use permit amendment to have an apartment in the church. <br /> <br />Further Discussion: Commissioner Shumway referred to the City's past action to deny a <br />permanent residence above a restaurant in the B-1 Business District and explained that them <br />is a measurable difference between that and a pastor using an apartment in a church a <br />maximum of 18 weeks a year. Commissioner LaDue noted that a pastor living in and about <br />a church premises is a historical practice. Commissioner Deemer inquired about residential <br />portions of churches being taxed.
