App. Ct. 5th Dist. 20.E 2) <br />ILLINOIS (01/06/12)—This case addressed the issue of whether a <br />non - home -rule unit of government has the authority to prohibit or bar <br />the drilling or operation of an oil or gas well within its municipal limits. <br />The Background/Facts: In June 2005, Tri -Power Resources, Inc. <br />("Tri-Power") obtained a permit from the Illinois Department of Natural <br />Resources (the "Department") to drill for oil on land it leased in the City <br />of Carlyle (the "City")—an unincorporated part of Clinton County. <br />The City's zoning code did not allow for the drilling or operation of <br />oil or gas wells within the City's municipal limits. Although the drilling <br />or operation of oil or natural gas wells was not expressly prohibited by <br />the City's zoning code, it was precluded by exclusion.
