b. These facilities shall be located only on sites having direct access to a <br />minor arterial street, collector or service road. <br />c. The applicant shall demonstrate that such use will not significantly lower <br />the existing level of service on streets and intersections <br />(12) Convenience grocery and /or food operations with convenience gas (no vehicle <br />service or repair) <br />(13) Day care services center (licensed) subject to the following standards: <br />a. No overnight facilities shall be provided for children served by the <br />daycare. <br />b. An outdoor recreational facility shall be continuous to the day care <br />facility, appropriately separated from the parking lot and driving areas by <br />a fence not less than 4 feet in height with additional standards as follows: <br />i. Shall not be located in any yard abutting a major thoroughfare; <br />ii. Shall not have an impervious surface for more than one -half of the <br />playground area, <br />iii. Shall extend at least 60 feet from the wall of the building or to an <br />adjacent property line, whichever is less, or shall be bound on not more <br />than two sides by parking and driving areas, and <br />iv. Shall be a minimum size of 2,000 sq. ft., or in the alternative 75 sq. <br />ft. per child at licensed capacity, whichever is the greater figure. <br />c. All state laws and statutes governing such use are strictly adhered to and <br />all required operating permits are secured. <br />(14) Outdoor seating accessory to a restaurant subject to the following standards: <br />a. The seating shall be located on private property. <br />b. The seating shall be of good patio or cafe type furniture that enhances the <br />appearance of the business. <br />c. The outdoor seating area shall be defined with the use of landscaping, <br />temporary fencing or other means that contains the tables and chairs for the use as <br />demonstrated on a site plan and approved by city staff. <br />d. No alcoholic beverages or food shall be served to persons outside of the <br />designated outdoor seating area. Signage shall be posted that restricts <br />consumption on alcohol outside of the designated outdoor seating area as <br />approved by staff. <br />19 <br />
