Mark Banwart stated that as property is platted under the 4 in 40 zoning, that portion of <br />property beyond the allowable lots will be labelled as outlots; outlots are not considered <br />buildable, and therefore the property valuation on them would be less. <br /> <br />Mr. John Keefe stated that he did receive written property valuation protests from persons <br />that could not be present this evening; those letters are as follows and should be made a part <br />of the record: <br /> <br />1) <br /> <br />Wes and Della Bulen - 3165 University, Mesa, Arizona - Mr. Keefe stated that the <br />Bulen's were wintering in Arizona and did not file for homestead credit on property <br />that has been homesteaded since 1951. <br /> <br />City Council directed Mr. Keefe to write a letter to Mr. Bulen informing him that <br />the County advises those persons that winter out of the state to file for homestead <br />before they leave the area. <br /> <br />2) <br /> <br />Albin Peterson - Mr. Keefe stated that Albin Peterson is protesting the removal of <br />the agriculture classification on his property claiming that the property is in fallow <br />but will be farmed again. Mr. Keefe stated that State guidelines require that the <br />property be in production every year and he asked Mr. Peterson to provide the City <br />with a letter detailing his agriculture plans for the property. Mr. Peterson's letter <br />has been received and is insufficient; it only indicates that the property should be <br />classified as agriculture because he has owned it for 30 years. <br /> <br />Mr. Hartley noted that the City has been negotiating for acquisition of property <br />from Albin Peterson for the extension of sewer and water, the terms and conditions <br />of the acquisition indicate Mr. Peterson's definite development plans for the <br />property which obviously do not include agriculture. <br /> <br />City Council directed Mr. Keefe to inform Mr. Peterson by letter just what kind of <br />written information the City will need to classify the property back to agriculture. <br />Mr. Peterson should also be informed that his only remaining opportunity to <br />resolve the matter at the local level is at the Board of Review continuation scheduled <br />for April 24, 1990. <br /> <br />3) <br /> <br />Brian Brockamp - Mr. Keefe stated that Mr. Brockamp's letter indicates that he <br />recently refinanced his home and the appraisal was set at $74,400; the City's <br />valuation is set at $78,300. Mr. Keefe stated that he will be contacting Mr. <br />Brockamp to schedule an appointment to reinspect the property. <br /> <br />4) <br /> <br />Gilbert Menkveld/Norm Holm - Mr. Keefe stated that he received a letter from <br />Menkveld/Holm's attorney, Jim Neilson, requesting that property valuations in <br />HY-10 Ramsey be adjusted to what their testimony indicated in a recent court case. <br />Mr. Keefe stated that he will not be taking any action to adjust property valuations <br />in this area until the court makes it's decision. <br /> <br />Councilmember Pearson stated that Jake Barthold has indicated some concerns with <br />property valuations. <br /> <br />Mr. Keefe stated that he has been in touch with Jake Barthold and his concerns have been <br />resolved. <br /> <br />Board of Review/April 4, 1990 <br /> Page 8 of 9 <br /> <br /> <br />
