CITY COUNCIL WORK SESSION <br /> <br />Topic: <br /> <br />Home Occupation Ordinance <br /> <br />By: <br /> <br />Megan Wald, Associate Planner <br /> <br />Background: <br />As part of the Chapter 9 rewrite, staff planned on requesting direction from the Planning <br />Commission and the City Council regarding how to address requests from residents to operate a <br />business from an accessory structure and to allow employees. <br /> <br />Lonny Menard expedited this process by applying for a Zoning Amendment. Mr. Menard is in a <br />situation where he owns an existing lawfi,tl nonwx)nforming accessory structure on a parcel that <br />does not contain a residential homestead. Mr. Menard is interested in selling the property. Due to <br />the construction materials, size of the accessory structure, and the fact that there is no home on the <br />property, Mr. Menard is finding that commercial users are mainly interested in the property. Mr. <br />Menard has requested that the City consider revising the Home Occupation Ordinance to address <br />situations similar to his. <br /> <br />The current Home Occupation Permit restricts home occupations to the confines of the dwelling, <br />which does not include attached or detached garages. The ordinance also does not allow for <br />employees other than residents that live on the property. <br /> <br />Outline below are the main additions to the current Home Occupation Ordinance: <br />,/ Establishes standards for occupations conducted within the dwelling <br /> <br /> · / Language has been added to allow businesses to be operated from an acmssory structure <br /> for parcels 3 acres or greater in size and establishes standards for these operations <br /> <br /> ,/ Gives the City Council the flexibility to approve or deny a business operation within an <br /> accessory structure that is located on a parcel that does not contain a residential dwelling <br /> <br /> ,/' A section establishing a list of specific business operations that may be considered a little <br /> more intensive (i.e. Waffic or production of product) for parcels t0 acres in size and greater <br /> that are located within the Rural Developing and Rural Preserve areas <br /> <br /> ~/ A table outlining the number of permitted employees, that are not occupants of the <br /> residential dwelling, which is based on lot size <br /> <br />-19- <br /> <br /> <br />
