CITY COUNCIL <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br /> <br />The Ramsey City Council conducted a regular meeting on Tuesday, April 24, 1990 at the <br />Ramsey Municipal Center, 15153 Nowthen Blvd. N.W., Ramsey, Minnesota. <br /> <br />Members Present: <br /> <br />Mayor Gary Reimann <br />Councilmember Richard Cich <br />Councilmember Stephen F. DeLuca <br />Councilmember Alan Pearson <br />Councilmember Kenneth Peterson <br /> <br />Also Present: <br /> <br />City Administrator David Hartley <br />City Attorney William Goodrich <br />City Engineer Peter Raatikka <br />Finance Officer Sandra Ashley <br />Community Development Director Mark Banwart <br /> <br />CALL TO ORDER <br /> <br />Mayor Reimann called the regular City Council meeting to order at 7:31 p.m. and led in the <br />Pledge of Allegiance to the Flag. <br /> <br />CITIZEN INPUT <br /> <br />City Attorney Goodrich read aloud his memo to the City Council dated April 24, 1990 <br />regarding adult book store regulation (see Attachment A to these minutes). Mr. Goodrich <br />went on to say that as late as 1986, the U.S. Supreme Court upheld a 'content neutral' <br />ordinance which regulated locations of adult entertainment centers in cities; those <br />ordinances that eliminate adult entertainment centers have been struck down by the <br />Supreme Court. <br /> <br />City Administrator Hartley stated that in an emergency special meeting on April 23, the City <br />Council adopted an ordinance establishing a moratorium on adult book stores in the city. <br />During the moratorium, City Staff will study what can be done about the situation and part <br />of that is a special meeting scheduled for May 29, at which time there will be a public <br />hearing. Mr. Hartley stated that he realizes that there are a lot of residents present who <br />want to express themselves about the subject of the adult book store but this meeting this <br />evening has not been properly advertised as being for that purpose. <br /> <br />Sharon Dahlgren - 6328 143rd Lane N.W. - Inquired as to what happens to the adult book <br />store between now and the public hearing on May 29. <br /> <br />Mr. Goodrich replied that the Police Department and appropriate investigative authorities <br />will determine if violations are occurring and if there is evidence of violations, prosecution <br />will be brought about. If the cities can obtain more than one criminal violation, the courts <br />have considered the operation to be a nuisance and the city can obtain an injunction to <br />enforce the code. <br /> <br />City Council/April 24, 1990 <br /> Page 3 of 19 <br /> <br /> <br />
