Mr. Goodrich stated that City Council has also been provided with copies of the "Adult <br />Entertainment Research Report" by the Rochester/Olmsted Planning Department dated <br />March 2, 1988. This report looks at studies done in Indianapolis, St. Paul and Phoenix <br />regarding secondary affects of adult entertainment centers. <br /> <br />Mr. Goodrich advised City Council to read both reports in their entirety. <br /> <br />Mr. Goodrich stated that the ordinances proposed for Council consideration at this time are <br />ordinances amending emergency Ordinance 90-7 adopted on April 23, 1990 and Ordinance <br />~90-8 adopted on May 8, 1990, which ordinances established a moratorium on the siting of <br />adult bookstores in Ramsey. <br /> <br />Mr. Goodrich proceeded to review the proposed ordinances amending Ordinances g90-7 <br />and #90-8, noting that the proposed ordinance amendments are much broader in their <br />definition of adult entertainment uses versus adult bookstores. <br /> <br />Mr. Goodrich explained that Ordinances #90-7 and #90-8 prohibited the siting of adult <br />bookstores during the moratorium. The U.S. District Court has determined that the City <br />cannot enforce that ordinance siting that it may cause harm to the present adult bookstore in <br />the City. The gist of the court decision is that there are no avenues for this type of business <br />in the community if the ordinance stands. In this particular judge's opinion, freedom of <br />expression cannot be prohibited, even for a temporary period. The new Section 5 in the <br />proposed ordinance amendment says that during the term of the moratorium, no adult <br />entertainment centers shall be located less than 1,000 feet from any residential district, <br />church, school or youth facility site. In addition, it says that no adult entertainment uses <br />may be located within 1,000 feet of any other adult entertainment use. <br /> <br />Mr. Goodrich also noted that Ordinances #90-7 and #90-8 provided for a violation of the <br />ordinances to be a misdemeanor. The court has said that the threat of criminal prosecution <br />for a violation of the ordinances imposes an impact and restricts freedom of expression of <br />an adult bookstore operator. The proposed amendments would allow the City to enforce <br />the ordinances by mandamus, injunction or any other appropriate civil remedy. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to introduce <br />Ordinances #90-X (An Ordinance Pertaining To The Location Of Adult Entertainment Uses <br />And Amending Ordinance No. 90-7, Which Ordinance No. 90-7 Is An Ordinance Placing <br />A Moratorium On The Siting Of Adult Bookstores As Defined Herein Within Any Zoning <br />District Of The City Of Ramsey) and ~90-X (An Ordinance Pertaining To The Location Of <br />Adult Entertainment Uses And Amending Ordinance No. 90-8, Which Ordinance No. 90-8 <br />Is An Ordinance Placing A Moratorium On The Siting Of Adult Bookstores As Defined <br />Herein Within Any Zoning District Of The City Of Ramsey). <br /> <br />Motion carried.
