elevation and continued use of the lot as a drainage area. Councilmember DeLuca <br />suggested bringing the lot elevation on Lot 1, Block 5, Rum Acre Estates to a maximum of <br />two feet below road grade which would leave sufficient room for construction of a swale <br />and the pond would retain as little water as possible, but enough in the event of a hundred <br />year storm. Mr. Dick Knutson, developer of Juniper Woods, was present and indicated <br />that the level of the ponding area on Lot 1, Block 5, Rum Acre Estates, prior to <br />construction, was 18 inches below road grade. Councilmember Cich indicated that the lot <br />in Rum Acre Estates should be brought up to its previous elevation utilizing permeable <br />materials. Mr. Otto noted that with the installation of storm sewer pipe, the owner of the <br />lot in Rum Acre Estates should be able to haul in additional fill to meet the 18 inch above <br />street grade requirement and then the lot would become a buildable lot. Mr. Goodrich <br />stated that Mr. Knutson owned the lot and if he wants to provide an alternate source for <br />drainage, he may make the lot buildable. Mr. Otto restated the Council's motion as being <br />one of selecting Alternative "A" as presented by the City Engineer in the Council Agenda <br />modified to include the installation of storm sewer pipe on Lot 1, Block 5, Rum Acre <br />Estates, filling of the existing pond in Rum Acre Estates back to the approximate elevation <br />existing prior to any excavation with the intent to maintain an approximate elevation of 18 <br />inches to two feet below the existing road grade and minimizing any standing water and <br />replacing the top soil and planting native grasses and flowers. Mr. Harfley stated that with <br />their motion Council is changing standards for storm sewer drainage systems. Mr. Hartley <br />stated that the Engineer is operating on the 100 year standard. Mr. Otto noted that the pipe <br />will still be sized for a 100 year storm but filling in the ponding area will lose some capacity <br />for surging. Mr. Goodrich inquired as to the potential damage for failure of the pipe to <br />handle surges. Mr. Otto replied that the water would spread over a wider area rather than <br />being contained in the basin. Mr. Otto also noted that there will be a cost incurred with <br />adding fill material to the ponding area and that will be the responsibility of the City. <br />Councilmember DeLuca inquired if the developer would be responsible for reimbursing the <br />City some of the restoration costs if he decides to make the lot a buildable lot. Mr. Hartley <br />replied that in accordance with the City Charter, it would be possible to specially assess the <br />property if the property owner did not oppose the assessment. Councilmember Peterson <br />stated that when the cost for restoration is known, a discussion should take place as to who <br />will be responsible for those costs. <br /> <br />Motion carried. Voting No: None Absent: None <br /> <br />Mr. Otto requested Council approval for a change order to install storm sewer pipe on Lot <br />1, Block 5, Rum Acre Estates. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Resolution g90-06-170 Approving a Change Order in the Amount of $8,520.00 for the <br />Installation of Storm Sewer System on Lot 1, Block 5, Rum Acre Estates. <br /> <br />Further discussion: Mr. Otto noted that this change order is for installation of storm sewer <br />pipe only and not for restoration of Lot 1, Block 5, Rum Acre Estates. Councilmember <br />Cich indicated that City Council would take action on the proposed restoration of the <br />subject lot after the cost estimates are provided. <br /> <br />Motion carried.
