A <br />Request for a Conditional Use Permit to Maintain Two <br />Parcel; Case of Stephen and Pamela Upton <br />Chairperson Nixt closed the regular portion of the Planning Commission <br />order to conduct the public hearing. <br />Public Hearing <br />Chairperson Nixt called the public hearing to order at 7 <br />Community Development Assistant Wald stated that City code �.,E#iat there shall not be more <br />than one main building on a lot unless otherwise provided for inti�ode. Mr. and Mrs. Upton <br />reside at 16101 Ramsey Boulevard Ramsey, and they are reembsfingANd6nditional use <br />permit to maintain a second dwellir}g (guest cottage) on the property to separate living <br />quarters for Mrs. Upton's mothe{��whem sheets for extended periodsf"tame. The subject <br />property is approximatly2.6 ac s;n s c; and is lo�ati ci_m ihe rural serve a area. Mr. and Mrs. <br />Upton have ch a 528 square footattadwgarage (2 ;a 'dother detached accessory <br />buildings that are 384 square feet and 1,08( squn sizeen the Uptons purchased the <br />property, the 1,080 square foot detached"' 6besso"'building�a� already heated, sheet rocked, <br />and supplied with a,workrng bathroom and electricity. The applicants would like to convert the <br />existing 1,080 square -fiat detached accesso� building into a guest cottage to provide separate <br />living quarters;. or Mrs on's mother when'she stays for extended periods of time. Mrs. <br />Upton's mother visits quite equently and is u�iiab e4o climb the stairs in the main dwelling. if <br />the Cit approves the conditional use pe t jrequest, the applicants are proposing to install <br />carpet, .cabinets;, windo�r ,arid -a ,shower provide for one bathroom, a kitchenette with dining <br />area, living robrra, and ozie'bedrooua. > <br />,an Mrs. Upton do not intend to rent or lease the <br />dwelling to persons:: af: urge. Upon reviewing Loving Care Senior Services and Don Kveton's <br />request ,for a condittonal use permit to maintain two dwellings on a parcel, the City Council <br />stated that applications farrfiw,,dwellings on a property should be viewed as a means to remedy a <br />unique or'already existmgsuation. The Council does not intend to set a precedent in allowing <br />t. two dwellings on a parc'(uv i"en new construction is required. Based upon the City Councils <br />review of the previous two requests for a conditional use permit to maintain two dwellings on a <br />parcel, it woulh:appear that Mr. and Mrs. Upton's request for a guest cottage (second dwelling) <br />would be considered new construction and contradicts the Council's desire to rectify only <br />existing non-coi'forming second dwellings and their desire not to set a precedent in allowing two <br />dwellings�n a parcel. <br />Citizen Input <br />Planning Commission/November 6, 2000 <br />Page 8 of 23 <br />
