Fairfax County Bd. of Supervi- <br />sors, 2012 WL 92243S (4th Cir. 2012) <br />The Fourth Circuit has jurisdiction over Maryland, North Carolina, South Carolina, <br />Virginia, and West Virginia. <br />VIRGINIA (03/19/12)—This case addressed the issue of whether a county <br />board of supervisors violated the federal Telecommunications Act of 1996 by ef- <br />fectively prohibiting wireless services when it denied a wireless service provider's <br />special exception application to construct an 88-foot telecommunications tower <br />in a residential neighborhood. <br />The Background/Facts: New Cingular Wireless ("AT & T"), contending that <br />it could only provide limited in -building and in -vehicle wireless services in the <br />Fort Hunt area of Fairfax County, Virginia (the "County"), submitted a special <br />exception application to the County's Board of Supervisors (the "Board").
