Councilmember introduced the following resolution and moved for its adoption: <br /> <br />RESOLUTION# 03-11- <br /> <br />A RESOLUTION APPROVING THE ISSUANCE OF A CONDITIONAL USE PERMIT TO <br />STEVEN SCHWAAB FOR AN OVERSIZED ACCESSORY BUILDING BASED ON <br />FINDINGS OF FACT # AND DECLARING TERMS OF SAME: <br /> <br /> WHEREAS, Steven Schwaab (Permittee) has properly applied for a conditional use permit <br />to exceed the accessory building size restriction for properties located outside the Metropolitan <br />Urban Service Area (MUSA) established in section 9.11.02 "Accessory Uses" of City Code on the <br />property generally known as 8732 168th Ave NW and legally described as follows: <br /> <br />Lot 7, Block 1, Autumn Heights, Anoka County, Minnesota <br /> <br />(Subject. Property) <br /> <br /> WHEREAS, the Planning Commission met on November 6, 2003, conducted the <br />public hearing and recommended City Council approval of the request. <br /> <br /> NOW THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY <br />OF RAMSEY, ANOKA COUNTY, STATE OF IMINNESOTA, as follows: <br /> <br />Based on Findings of Fact #__, a conditional use permit (Permit) to exceed the accessory <br />building size restriction for properties located outside the MUSA as established in City Code, is <br />hereby granted to Steven Schwaab, hereinafter referred to as the "Permittee". <br /> <br />That the overall square footage for accessory buildings may exceed the 1,488 square foot <br />accessory building size restriction for properties located outside the Metropolitan Urban Service <br />Area by a total of 161 feet in order to accommodate the inside storage of private-use equipment <br />and vehicles. <br /> <br />3. That the construction of the detached accessory building on the Subject Property shall require <br /> issuance of a building permit from the City of Ramsey. <br /> <br />4. That the accessory building shall be properly constructed and maintained in accordance with all <br /> applicable Uniform Building Codes. <br /> <br />5. The Permittee herein agrees that no business use will be operated in the detached accessory <br /> building unless such use is permitted in accordance with the City Code. <br /> <br />6. That this Permit shall be perpetual in duration as long as the terms are herein Complied with. <br /> <br />7. That the Permittee shall be responsible for all City costs incurred in administering and enforcing <br /> this Permit. <br /> <br />8. That the City Administrator, or his/her designee, shall have the right to inspect the premises for <br /> compliance and safety purposes annually or at any time, upon reasonable request. <br /> <br /> <br />
