CASE # <br /> <br /> PUBLIC HEARING <br />REQUEST FOR A CONDITIONAL USE PERMIT FOR AaN <br />OVERSIZED ACCESSORY BUILDING; <br /> CASE OF DON VOLNER <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from Don Volner for a conditional use permit to exceed the <br />accessory building size restrictions established in City Code on the property located at 8121 154th <br />Ave. NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Proposed Site Plan <br />c) Letter from Applicant <br />d) Proposed findings of fact <br />e) Proposed conditional use permit <br />f) Proposed resolution denying conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public heating to property owners within 350 feet of the <br />subject property. Staffsent out notices to all property owners within 350 feet. . <br /> <br />Observations: <br /> <br />The subject property is approximately 0.86 acres (37,464 square feet) in size and is located <br />outside the Metropolitan Urban Service Area (MUSA). Under City Code, parcels between 14,880 <br />sq. ft. and 43,559 sq. ft. can have up to 1,488 square feet of accessory building space. The <br />proposed building will be 1,820 square feet (28' x 65') in size. Coupled with the existing garage <br />(484 sq. ft.) and shed (192 sq. ft.), the applicant would have 2,496 sq. ft. in accessory building <br />space. <br /> <br />However, Mr. Volner has stated that the existing shed would be removed and that the existing <br />attached garage will be converted into living space prior to the final inspection of the proposed <br />accessory structure. The net result will be an overage of 332 square feet. Mr. Volner has also <br />agreed to submit a surety, in the amount of $2,000, to ensure that this work will-transpire prior to <br />the completion of the proposed structure. The City would not issue a building permit for this <br />structure until the surety has been submitted. <br /> <br />The applicant would like to exceed the 1,488 square feet restriction in order to construct a <br />detached accessory building that would accommodate the indoor storage of private use <br />equipment, tools, and materials. The proposed detached accessory building wilt be located in the <br />rear yard. The proposed accessory building location will meet and/or exceed all setbacks <br />established in the R-1 Rural Developing District Bulk Standards. <br /> <br />13 <br /> <br /> <br />
