Commissioner Brauer introduced the following resolution and moved for its adoption: <br />RESOLUTION #12 -05 -065 <br />A RESOLUTION ADOPTING FINDINGS OF FACT #0899 RELATING TO A <br />REQUEST FOR A VARIANCE TO THE PLATTING REQUIREMENTS IN CITY CODE <br />TO ALLOW A METES AND BOUNDS SUBDIVISION <br />WHEREAS, Makowsky Family Farm, LLC, hereinafter referred to as "Applicant ", has <br />properly applied for a variance to platting requirements established in Chapter 117 Article II <br />(Subdivision) of the Ramsey City Code to permit a metes and bounds subdivision to facilitate the future <br />re- subdivision of property. <br />NOW THEREFORE, BE IT RESOLVED BY THE PLANNING COMMISSION OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1. That the Applicant appeared before the Planning Commission for a public hearing on May 3, <br />2012, and that said public hearing was properly advertised and that the minutes of said public <br />hearing are hereby incorporated as a part of these findings by reference. <br />2. That the Applicant owns a parcel that is approximately 57 acres in size and desires to <br />separate the dwelling unit and accessory structures from the vacant, agricultural use <br />surrounding said structures. <br />3. That the Applicant has stated that the nature of the need for a lot split creates a practical <br />difficulty in complying with City Code requirements that require all subdivision be <br />completed through the platting process. <br />4. That the Applicant has stated that no new buildable lots are intended to be created with the <br />metes and bounds subdivision. <br />5. That the Applicant has stated that the vacant parcel will be subdivided in the future for <br />development consistent with existing zoning, and will be subdivided in accordance with <br />platting requirements at that time. <br />6. That Chapter 117 Article II (Subdivision) of City Code requires that any new lots be created <br />through the platting process. <br />7. That Section 117 -561 (Procedural Variances) establishes a process to grant a variance to <br />platting requirements, when strict compliance with these requirements may cause a practical <br />difficulty or undue hardship, provided the variance does not affect the spirit and intent of the <br />Section. <br />8. That the need for the Variance will be eliminated by the eventual platting of the remnant <br />parcel. <br />
