CC Regular Session 7. 3. <br />Meeting Date: 08/28/2012 <br />By: Tim Gladhill, Community Development <br />Information <br />Title: <br />Adopt Ordinance to Vacate Drainage and Utility Easements and Right of Way for Sunwood Drive Within the COR <br />TWO Subdivision located East of Armstrong Boulevard and South of Bunker Lake Boulevard; Case of the City of <br />Ramsey Housing and Redevelopment Authority <br />Background: <br />A contingency of approval of the COR TWO plat included vacating certain existing drainage and utility easements, <br />as well as a portion of right of way for Sunwood Drive. The areas to be vacated are indicated on the Preliminary <br />Plat sheets. The request has been reviewed as part of the Preliminary and Final Plat review of COR TWO, and Staff <br />finds the request consistent with said review, contingent upon compliance with the City Staff Review Letter dated <br />July 27, 2012revised August 9, 2012. <br />Notification: <br />In accordance with Minnesota Statute and City Code, Staff attempted to notify all Property Owners within 700 feet <br />of the Preliminary Plat Public Hearing via Standard US Mail, which noted the areas requested to be vacated. City <br />Code requires that all Property Owners within 350 feet of the Property be notified. <br />Observations: <br />Easements are being vacated due to the realignment of Sunwood Drive. Proper easements based on the new <br />alignment of Sunwood Drive will be dedicated on the COR TWO plat. <br />Recommendation: <br />Staff recommends approval of the ordinance vacating certain drainage and utility easements and right of way for <br />Sunwood Drive within the COR TWO plat. <br />Funding Source: <br />Review of the case is being handled as part of regular Staff duties. <br />Council Action: <br />Motion to waive the City Charter requirement to read the ordinance aloud -AND- adopt the ordinance vacating <br />certain drainage and utility easements and right of way for Sunwood Drive within the COR TWO plat. <br />Roll Call Vote: <br />Councilmember Backous <br />Councilmember Wise <br />Councilmember Strommen <br />Councilmember Tossey <br />Councilmember McGlone <br />Councilmember Elvig <br />Mayor Ramsey <br />Attachments <br />Site Location Map <br />Preliminary Plat Sheets <br />
