no written or verbal comments submitted.
Recommendation:
In reviewing this request, the Planning Commission noted that the applicant has gone through this process once
already and the City is not aware of any issues related to the use in question, which is why Staff was recommending
approval of the request. Rather than have the applicant go through this process and expense again in five (5) years,
the Planning Commission expressed a desire to either process this request administratively in the future, streamline
the process to eliminate as much time and expense as possible for the applicant, or extend the term of the permit
beyond five (5) years.
The Planning Commission recommended that the City Council approve the request for an interim use permit and
directed Staff to research potential options to extend the term of the interim use permit or at least streamline the
process for the applicant in the future based on the fact that they have been operating on the Subject Property for
three (3) years already with no concerns or issues that have been brought to the City's attention. The Planning
Commission also recommended that the interim use permit allow the applicant to expand into an adjacent suite as
long as all other terms of the permit remain unchanged and in effect.
City Code does state that an Interim Use Permit shall terminate upon a date or event that can be identified with
certainty, with the maximum duration of five (5) years from the date of approval, unless otherwise approved by the
City Council. Since the Subject Property is within the officially mapped portion of Highway 10, the City Council
could, if desired, extend the term of the permit beyond five (5) years and tie it to the expansion of Highway 10.
Based on the Planning Commission's recommendation, the Findings of Fact have been revised to include their
recommendation of an extended term for the permit (Finding #11) and, more importantly, Conditions #4 and #5 of
the Interim Use Permit have been amended/added to state that the permit will expire upon the award of Highway 10
expansion project and that the applicant shall be permitted to expand into an adjacent suite as long as all other terms
of the permit are unchanged and upheld.
Funding Source:
The Applicant is responsible for all City costs incurred in administering and enforcing this Permit.
Council Action:
Motion to adopt Resolution # adopting Findings of Fact relating to the request for an Interim Use Permit.
-and-
Motion to adopt Resolution # approving the request for an Interim Use Permit that will expire upon the
awarding of the Highway 10 expansion project and declaring the terms as proposed, subject to review of the City
Attorney and contingent upon receiving written consent of the Subject Property owner.
Attachments
Site Location Map
Aerial View of Site
Summary of Original Request in 2009
Draft Planning Commission Meeting Minutes Dated June 7, 2012
Proposed Findings of Fact
Proposed Interim Use Permit
Form Review
Inbox Reviewed By Date
Tim Gladhill Tim Gladhill 06/20/2012 10:47 AM
Kurt Ulrich Kurt Ulrich 06/20/2012 09:00 PM
Form Started By: Chris Anderson Started On: 06/11/2012 11:36 AM
