General <br />33 definition, compliance and administration. <br />ORDINANCE #12- <br />CITY OF RAMSEY <br />ANOKA COUNTY <br />STATE OF MINNESOTA <br />AN AMENDMENT TO CHAPTER 117 WHICH IS KNOWN AS THE ZONING AND <br />SUBDIVISION OF LAND CHAPTER OF THE CITY CODE OF RAMSEY, MINNESOTA. <br />AN ORDINANCE AMENDING SUBDIVISIONS II (ENVIRONMENTAL PROTECTION OVERLAY DISTRICTS). IV <br />(SHORELAND MANAGEMENT OVERLAY DISTRICT) AND V (SCENIC RIVER PROTECTION OVERLAY <br />DISTRICT) SECTION 117 319 (ACCESSORY USES AM_^ Q1_'!' ^!N6S}OF CHAPTER 117 OF THE RAMSEY CITY <br />CODE. <br />The City of Ramsey ordains: <br />SECTION 1 AUTHORITY <br />This ordinance is adopted pursuant to and under the authority of the City Charter of the City of Ramsey. <br />SECTON 2 AMENDMENTS <br />City Code Chapter 117 (Zoning and Subdivisions) Article II (Zoning) Division 4 (District Regulations) <br />Subdivisions II, IV and V are hereby repealed and replaced with Subdivision II (Shorelands) as follows <br />(additions indicated as underline, deletions indicated as ctriko through): <br />Subdivision laq. Shorelands Management Overlay District <br />34 (a) Authorization. The ordinance from which this subdivision is derived is adopted <br />35 pursuant to the authorization and policies contained in Minn. Stats. ch. 103F, Minn. <br />36 Rules pts. 6120.2500-6120.3900, and the planning and zoning enabling legislation <br />37 in Minn. Stats. ch. 462. <br />38 (b) Policy. The uncontrolled use of shorelands, includina lakes and tributary streams and <br />39 rivers, of the city affects the public health, safety and general welfare not only by <br />40 contributing to pollution of public waters, but also by impairing the local tax base. <br />41 Therefore, it is in the best interests of the public health, safety and welfare to provide <br />42 for the wise subdivision, use and development of shorelands of public waters. The <br />43 state legislature has delegated responsibility to local governments of the state to <br />44 regulate the subdivision, use and development of the shorelands of public waters <br />1 <br />
