84 Sec. 117 222. General provisions and definitions. <br />85 (c) Jurisdiction -Lakes and tributary streams. The provisions of this subdivision (Sections <br />86 117-221 through 117-224) shall apply to the shorelands of the public water bodies as <br />87 classified in Section 117-2242. not including rivers. Pursuant to Minn. Rules pts. <br />88 6120.2500-6120.3900, no lake, pond, or flowage less than ten acres in size in <br />89 municipalities or 25 acres in size in unincorporated areas need be regulated in a <br />90 local government's shoreland regulations. A body of water created by a private user <br />91 where there was no previous shoreland may, at the discretion of the city council, be <br />92 exempt from this subdivision. <br />93 (d) Jurisdiction -Rivers. The provisions of this subdivision (Sec.117-2231 shall apply to <br />94 the Critical River Area Overlay (Mississippi River) as amended. due to 2012 Special <br />95 Legislation that exempts the Mississippi River from the Wild and Scenic regulations. <br />96 and (Sec. 117-224 4 )through 117 2911. the Scenic River Protection Overlay District <br />97 (Rum River). <br />98 I (o) Compliance. The use of any shoreland of public waters (including lakes, <br />99 tributary streams and rivers); the size and shape of lots; the use, size, type and <br />100 location of structures on lots; the installation and maintenance of water supply and <br />101 waste treatment systems, the grading and filling of any shoreland area; the cutting of <br />102 shoreland vegetation; and the subdivision of land shall be in full compliance with the <br />103 I terms of this subdivision and other applicable regulations. <br />104 (Code 1978, § 9.25.02, subds. 1, 2; Ord. No. 04-32, 5-30-2005) <br />105 Sec. 117 223. Administration. <br />106 I (f) Permits required and standards. <br />107 (1) A building permit is required for the construction of buildings or building <br />108 additions (and including such related activities as construction of decks and <br />109 signs), the installation and/or alteration of sewage treatment systems, and <br />110 those grading and filling activities not exempted by section 117-225222 (c ) <br />111 below.' Application for a permit shall be made to the building official on <br />112 the forms provided.
