1679 finding by the city that such offensive conduct cannot otherwise be <br />1680 reasonably controlled. <br />1681 (3) Public access, private property. Public pedestrian access shall be provided to <br />1682 the riverfront for all non -water -dependent uses that are: <br />1683 a. Commercial or industrial. <br />1684 b. Developed as a planned unit development or requiring subdivision <br />1685 approval. <br />1686 c. Access to the riverfront may be denied to any person who creates a <br />1687 nuisance or who engages in illegal conduct on the property and <br />1688 public access may be temporarily or permanently closed upon a <br />1689 finding by the city that such offensive conduct cannot otherwise be <br />1690 reasonably controlled. <br />1691 (4) Riverfront uses. Riverfront uses shall be preferred in the following order: <br />1692 a. Water dependent; <br />1693 b. Non -water dependent with public pedestrian access; and <br />1694 c. Non -water dependent without public pedestrian access. <br />1695 I (ef) Marinas, barge fleeting areas and loading facilities. <br />1696 (1) Boat launching ramps. <br />1697 a. Boat launching ramps may be located only where access streets are <br />1698 adequate to handle the traffic load generated by the facility. <br />1699 b. Shared or joint use accessory parking will be preferred. Loading will <br />1700 be permitted only at ramps. Parking areas must be screened from the <br />1701 river and adjoining residential property and located at least 50 feet <br />1702 from the normal high water mark. <br />1703 c. The impact of the accessory parking must not adversely affect the <br />1704 environmental quality of the site or the surrounding neighborhood. <br />1705 d. Boat launching ramps and minor accessory buildings and haul -off <br />1706 facilities must be in character and scale with the surrounding <br />1707 neighborhood. <br />1708 (2) Public marinas. Public marinas shall be permitted subject to the following <br />1709 conditions: <br />1710 a. The marina must have lavatory facilities adequate to service the <br />1711 marina clientele. <br />1712 b. Off-street parking areas should be provided in accordance with the <br />1713 requirements set forth for boat launching ramps. <br />1714 c. Areas for the winter storing of boats should be naturally screened <br />1715 from view from the river and from upland lots. <br />1716 d. The marina shall be designed for and used only by pleasure craft. <br />1717 e. Maximum height of any buildings or structures shall be 35 feet. <br />47 <br />
