Mr. Gary Reimann and Mr. Steve DeLuca took oaths of office for mayor and <br />councilmember respectively. <br /> <br />Discuss Revocation Of Conditional Use Permit To Operate <br /> Automobile Sales And Repair Service; Case. Of. Mr. Gerald Root: <br /> <br />Ms. Norris stated that at the August 26, 1986 meeting, Council gave Mr. Root <br />one month to get in compliance with the terms of his conditional use permit for <br />an automobile sales and repair service. Ms. Norris presented recent photos of <br />the subject property and stated that in her opinion, Mr. Root is still not <br />comp lying. <br /> <br />Mr. Goodrich stated that it appears that another use, besides the use for which <br />the permit was issued, is continuing to be carried on at the subject property. <br />Mr. Goodrich stated that it also appears that no work has been done towards <br />surfacing the parking area. <br /> <br />Attorney Ronald Ylitalo was present representing Mr. Root and stated that it is <br />his understanding that Mr. Root has been taking action to get in compliance; <br />tire stockpile has been removed and a considerable amount of gravel has been <br />hauled in for use on the parking area, weeds have been cut and vehciles are <br />parked in an orderly fashion. Mr. Ylitalo stated that Mr. Root was willing to <br />surface the parking lot with blacktop because of an agreement with the <br />contractor storing his equipment on Mr. Root's property but it was assumed that <br />gravel would satisfy the parking area requirement. <br /> <br />Mr. Goodrich noted that the ordinance requires that parking areas be a 'hard, <br />dust free surface'; it does not specify blacktop. <br /> <br />Mr. Ylitalo stated that perhaps the parking area would be in compliance if it <br />were leveled off more than it is. Mr. Ylitalo also noted that the contractor <br />storing his equipment on the property may be purchasing the property from Mr. <br />Root. Mr. Ylitalo stated that this case was to have been addressed at the <br />Council meeting scheduled for September 23; they were notified that the <br />September 23 meeting was cancelled and not informed that the case would be <br />addressed today, September 30. <br /> <br />Mr. Goodrich stated that tonight's meeting is continued from the meeting that <br />was to be conducted on September 23; Mr. Root has had an extra week to get into <br />compliance. Mr. Goodrich stated that the Council is not hearing anything <br />different than they heard a month ago; Mr. Root must understand the seriousness <br />of the problem; definite action should be taken to insure compliance with the <br />permit agreement. <br /> <br />Mr. Ylitalo requested that Mr. Root be granted another 30 days to get into <br />compliance. Mr. Ylitalo noted that the contractor is not carrying on an <br />additional business on the Root property; he is simply storing his trucks at <br />that address. <br /> <br />Mr. Goodrich stated that the City considers storing or parking company <br />equipment at a property as a business use; this standard has been set by the <br />city in other similar situations. <br /> September 30, 1986 <br /> <br />Page 5 of 16 <br /> <br /> <br />
