Presentation <br /> <br />Mr. Gordon advised there will be a public hearing and review every month through June. He <br />stated that tonight the Commission will review the proposed amendments to the following <br />sections of Chapter 9:9.01 Introduction, 9.02 Definitions, 9.03 Administration, 9.20.21 B-1 <br />Business, 9.20.23 B-2 Business, 9.20.24 E- 1 Employment, 9.20.25 E-2 Employment. <br /> <br />Commissioner Brauer indicated the word 'digital' should be included in the Adult Use general <br />definition. <br /> <br />Commissioner Van Scoy noted that in the Building Height definition it should say 'or', not <br />'over'. <br /> <br />Commissioner Shepherd stated that drive-in establishment strikes her as an archaic te~Tn. <br /> <br />Mr. Gordon indicated this was used as a conditional use permit in B1 districts, and should <br />probably say drive thru, not drive-in. <br /> <br />Chairperson Nixt asked if drive-thrus were prohibited in certain districts. <br /> <br />Mr. Gordon indicated that in BI, it is a conditional use permit; and in B2 it is permitted. He <br />stated B 1 is closer to residential areas and should to be more restrictive. <br /> <br />Commissioner Brauer stated the language there seems a little vague. He indicated it obviously <br />means in the vehicle while being serviced but it needs a little clarification. Commissioner Brauer <br />recommended it be changed to 'persons occupying a motor vehicle'. <br /> <br />(;ommissioner Shepherd asked about Junk Yard and Vehicle Wrecking Yard. She asked if it was <br />necessary to have these separate. <br /> <br />Community Development Director Frolik indicated it was insurance to make sure they cover all <br />instances. <br /> <br />Commissioner Shepherd stated under Motels/Motor Hotels, 'Motor' is slashed. She asked the <br />reason for that. <br /> <br />Principal Planner Trudgeon indicated that again it is an archaic term. <br /> <br />Commissioner Shepherd indicated it then needed to be removed fi'om page 175 also. <br /> <br />Mr. Gordon referred the Commission to Section 9.03.03, Subd. 7. He indicated this used to say <br />it' you are requesting a change from one zone to another, sometimes it requires a 4/5 vote, <br />sometimes a majority vote. This has been changed to say 'in accordance with State statute'. He <br />stated Section 9.03.04, Conditional Rezoning, has been added to give the City Council the option <br /> <br />Planning Commission/April 3, 2003 <br /> Page 10 of 14 <br /> <br /> <br />
