1. Use of Federal Revenue Sharing Funds. <br /> <br />Mayor Reimann called the special Council meeting back to order at 8:51 p.m. <br /> <br />COUNCIL BUSINESS CONTINUED <br /> <br />Request For Metes And Bounds Subdivision; Case Of Dorothy Hunt; <br /> <br />Mrs. Hunt was represented by her son, Merlin Hunt, and her realtor, Diane <br />Omdahl. <br /> <br />Mr. Hunt stated that his mother is selling her 40 acre farm on Cty. Rd. #5; the <br />buyers are financing with VA; VA mortgage limits are set at 10 acres with <br />buildings; plan is to split off a 10 acre parcel with buildings to be financed <br />VA; balance of property will be purchased by same buyer on a contract for deed. <br /> <br />Mr. Hartley stated that Planning and Zoning addressed this case earlier this <br />evening and their recommendation was to approve the metes and bounds <br />subdivision contingent upon no further development of the 30 acre parcel <br />without going through proper platting procedures. <br /> <br />Councilmember DeLuca inquired if the buyers are aware of the contingency. <br /> <br />Ms. Diane Omdahl stated that the P&Z just took that action this evening; the <br />buyer's have not been made aware of that contingency; buyers do not have plans <br />to develop the 30 acres. <br /> <br />Merlin Hunt inquired why the additional restriction is necessary; given current <br />ordinances, one building permit would be allowed for the 30 acre parcel; any <br />further building permits would require subdivision and platting. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember Cox to approve <br />Mrs. Dorothy Hunt's request for a metes and bounds subdivision of her 40 acre <br />parcel located on Cty. Rd. #5. <br /> <br />Further Discussion: Councilmember DeLuca stated that he can agree with a metes <br />and bounds subdivision as long as the buyer is made aware of what he can do <br />with the property. Councilmember Cox stated that the buyer must take <br />responsibility to know development rights of property he is buying. <br />Councilmember DeLuca stated that he feels there should be communication between <br />buyers, sellers and the city to prevent misunderstandings. Councilmember Cox <br />stated that there are ordinances that can be referred to. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />Schlueter and DeLuca. Voting No: None. <br /> <br />pUBLIC H~ARING$ CONTINUED <br /> <br />Mayor Reimann adjourned the special Council meeting at 9:09 p.m. in order to <br />conduct the following public hearing: <br /> <br />2.
