or not the material used on the parking area meets city code requirement as <br />being 'durable, dust-free'. Council also directed staff to draft a new <br />conditional use permit that would clearly specify all the conditions for <br />operation of Mr. Root's business; that has been forwarded to Mr. Root and his <br />attorney and no response has been received. The City Engineer has determined <br />that the material Mr. Root used in his parking area is not durable, dust-free. <br /> <br />Mr. Ylitalo was present representing Mr. Root and stated that he and Mr. Root <br />did not have time to respond to the new condtional use permit that was drafted <br />as they just received it today. Mr. Ylitalo stated that it was his <br />understanding that the ordinance does not specifically require blacktop or <br />concrete surfacing of parking areas; if the traprock that was applied does not <br />qualify as durable, dust-free, then what besides blacktop or concrete does? <br /> <br />City Engineer Raatikka stated that even though the ordinance does not say <br />concrete or blacktop, he interprets 'paved with a durable, dust-free' <br />material to mean bituminous or concrete. <br /> <br />Mr. Ylitalo stated that the minutes of a prior council meeting regarding this <br />same issue reflect that ordinance does not require blacktop or concrete. <br /> <br />Mr. Goodrich replied that the ordinance does not specifically require blacktop <br />or concrete; it requires paving with something that is durable and dust-free. <br />The engineer has determined that the traprock Mr. Root used is not durable and <br />dust-free. Council can either grant a variance accepting the traprock; <br />require another surfacing material and a bond to insure it is accomplished; or <br />Mr. Root can apply another material that will meet 'durable, dust-free'. <br /> <br />Motion by Councilmember Sorteberg and seconded by Councilmember DeLuca to <br />require that Mr. Gerald Root surface the driveway and parking area at his <br />automobile sales and repair business located at 14700 Nowthen Blvd. N.W. by <br />June 1, 1987 and that Mr. Root provide the City with an escrow, in an amount to <br />be determined by the City Engineer, to insure accomplishment of surfacing. <br /> <br />Further Discussion: Mr. Goodrich stated that Mr. Root should be given a <br />deadline for providing the escrow. Mr. Ylitalo stated that providing an escrow <br />would be a hardship for Mr. Root as it would tie up his money until the next <br />construction season and his business is not doing well. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers Sorteberg, Cox, <br />Schlueter and DeLuca. Voting No: None. <br /> <br />Council consensus was that Mr. Root has until January 1, 1987 to provide the <br />escrow. Mr. Raatikka stated that he will determine the escrow amount this <br />evening. <br /> <br />Mayor Reimann noted that the ordinance requires paving of both driveway and <br />parking area. <br /> <br />Councilmember Cox noted that if Mr. Root uses any material other than blacktop, <br />asphalt or concrete, there will have to be a determination by the City Engineer <br />that it is durable and dust-free. <br /> <br />City Council/November 25, 1986 <br /> <br />Page 6 of 17 <br /> <br /> <br />
