Councilmember Elvig introduced the following resolution and moved for its adoption: <br />RESOLUTION #12 -08 -125 <br />A RESOLUTION REQUESTING MINNESOTA LEGISLATURE REVIEW OF <br />MINNESOTA STATUTE SECTION 462.357, SUBDIVISION 6a THROUGH <br />SUBDIVISION 8 <br />WHEREAS, Minnesota Statute 462.357 Subd. 6a through Subd. 8 states that persons <br />with disabilities shall not be excluded by zoning ordinances or other land use regulations from the <br />benefits of normal residential surroundings; and <br />WHEREAS, the City of Ramsey (the "City ") has adopted its ordinances to be consistent <br />with the requirements of Minnesota Statute Chapter 462 and agrees that many of the uses noted <br />in the Statute shall not be prevented from the benefits of normal residential surroundings; and <br />WHEREAS, the City has noted there are potential adverse secondary effects with <br />permitted residential uses including, but not limited to, additional police calls, public nuisance <br />complaints, off - street parking violations, and maintenance of buildings; and <br />WHEREAS, the City has adopted ordinances for all residential uses to address issues of <br />public nuisance, off - street parking, and building maintenance, regardless of whether a license is <br />required by Minnesota Statute; and <br />WHEREAS, the City still experiences complaints from area residents regarding lack of <br />advance notification and issues of public nuisance; and <br />WHEREAS, the City believes its ability to respond to some of these complaints are <br />hindered by the protections included in Minnesota Statute Chapter 462; and <br />WHEREAS, the City appreciates recent enhancements by the State of Minnesota and <br />Anoka County in advance notification of license approvals for residential uses requiring license <br />approvals <br />NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF <br />RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br />1) That the City requests that the Minnesota Legislature review and update Minnesota <br />Statute Chapter 462 related to permitted residential uses in residential areas to allow local <br />units of government the ability to better respond to concerns related to permitted <br />residential uses including, but not limited to, addressing excessive police calls, providing <br />for requirements for notification to adjacent residents, and allowing for separation <br />requirements preventing concentrations of uses that have proven adverse secondary <br />effects. <br />
