8. That as part of the 2011 Permit, the Applicant was required to install a fire suppression <br />system that is operational and approved by the City by September 1, 2012. <br />9. That the Planning Commission recommended approval of an Interim Use Permit for five (5) <br />years contingent on the system being operational and approved by the City by the end of <br />September, 2012. <br />10. That the Applicant completed the installation of a fire suppression system on the Subject <br />Property and the system was approved by the City on September 20, 2012. <br />11. That on August 13, 2012, the City Council waived the application and escrow fees associated <br />with this request due to the unique circumstances and limited term (nine [9] months) of the <br />2011 Permit. <br />12. That the proposed use will not adversely impact traffic in the area. <br />13. That the proposed use will not be dangerous or detrimental to persons residing or working in <br />the vicinity of the use or to the public welfare. <br />14. That the proposed use will not substantially or adversely impair the use, enjoyment or market <br />value of surrounding properties. <br />15. That the proposed use will be operated and maintained so as to be harmonious and <br />appropriate in appearance with the existing or intended character of the general vicinity and <br />such use will not change the essential character of the area. <br />16. That the proposed use will not create additional requirements at public cost for public <br />facilities and services. <br />17. That the proposed use will not be detrimental to the economic welfare of the community. <br />18. That the proposed use will not be disturbing or hazardous to existing or future neighboring <br />uses. <br />19. That the proposed use will not involve uses, activities, processes, materials and equipment <br />and conditions of operation that may be detrimental to any persons, property or the general <br />welfare, by reason of excessive production of traffic, noise, smoke or glare. <br />20. That the proposed use will be in accordance with the objectives of the intent of Section 117- <br />52 (Interim Use Permits) of the City Code. <br />RESOLUTION #12 -09 -146 <br />Page 2 of 3 <br />
