AND WHEREAS, the Board of Adjustment conducted a public hearing on February 5, <br />2004, pursuant to Section 9.03.05 of the Ramsey City Code. <br /> <br />NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF ADJUSTMENT OF THE <br />CITY OF RAMSEY, ANOKA COUNTY, STATE OF MINNESOTA, as follows: <br /> <br />That based on Findings of Fact #__ a variance to the front yard setback for an accessory <br />structure, to construct an accessory structure closer to the front property line than the <br />principal structure, and to the established setback from a Natural Environment Lake on the <br />Subject Property is hereby granted. <br /> <br />2. That the accessory structure constructed on the Subject Property shall maintain a minimum <br /> setback of forty (40) feet/thirty (30) feet Ii'om the front property line. <br /> <br />3. That the accessory structm'e constructed on the Subject Property shall maintain a minimum <br /> setback from Rogers Lake of 113 feet/123 feet. <br /> <br />4. That no other structures or additions shall be constructed in the front Yard unless it is in <br /> accordance with City Code. <br /> <br />5. That the Permittees shall be responsible for all costs'incurred in administering and enforcing <br /> this variance. <br /> <br />6. That the Permittee shall obtain all necessary permits prior to commencing any construction of <br /> the accessory structure. <br /> <br />That the accessory structure shall be used for storage of personal property and that no <br />commercial activity of any type shall be permitted in said structure unless it is in accordance <br />with City Code. <br /> <br />8. That the Permittee agrees that the terms of this Variance shall be binding upon its successors <br /> and assigns. <br /> <br />That this Variance shall automatically expire if the use is not initiated by February 5, 2005, <br />and issuance of the building permit shall constitute initiation. The Permittee may petition for <br />an extension of time in which to complete the variance.
