Mr. Meloche stated the issue is City Code, which requires 200 feet of access to a City Road. He
indicated the other variance has been working beautifully for 14 years. He stated the variance
they are requesting now is different than those requested previously, in that there is a home that is
there now, and they just want one other lot platted. He stated when the 40 acres to the north are
developed, w~ch has been rezoned to 2 ½ acres per lot and is being prepared for development, a
road will be cCming down to a permanent 66-foot easement at his property. He stated he spoke
with the City Engineer about access from that road and his willingness to provide a small cul-de-
sac at that tim~.

Mr. Meloche'S~ daughter, Karen, stated she has lived close to her parents since she was a little
girl l She stated the last few years they have lived in different cities, and have the desire to be
neighbors again. She indicated they would build a home in line with the houses that are there.
She stated there are a million personal reasons she wants to live close to her parents, and hopes
they can make it happen. She indicated they do not want to further subdivide the land, and do
not want to se[il the rest off; they simply want to live close together.

Chairperson Nixt verified they would be platting one four-acre lot and a second lot for the
remaining acreage.

Mr. Meloche 'indicated that was correct. He stated the main reason he sees for the 200 feet
requirement i~ to ensure access for emergency vehicles and utilities. He indicated his home has
geo-thermal heat, and he predicts his daughter's home will as well. He stated the major reason
for the public ~oad access is emergency vehicles and the concern the city would not be able to get
to them, but Ire would be more than willing to sign a 'hold harmless' agreement to the city. He
indicated the~ are able to maintain the road, and showed a picture of the tractor already on the
property. He stated the fire truck was there this morning, and had plenty of room to access the
property; big ~nough for even the City's biggest fire truck.

Chairperson Nixt asked what the deficiency was of the frontage.

Assistant Community Development Director Trudgeon stated they' do not have any frontage
because it is aprivate road.

Chairperson Nixt asked about the possibility of deeding the land for the road to the City.

Assistant com~ munity Development Director Trudgeon stated Mr. Meloche does not own the
land they wot~ld need for the easement, and .the current owner is not interested in selling. He
indicated one~ issue for staff is that the driveway is ¼ mile long. They recognize it is well
maintained, but there is no guarantee that will continue. Staff does not want to get in the habit of
creating variances for private roads. He noted the current variance is 20 years old, and was done
with the stipulation there would be no other lot splits. He added one issue is the liability of
trying to get bhck on the property. ,

Board of Adjustment/October 2, 2003
