Observations:

As mentioned earlier, a request for extension must be reviewed by the Planning Commission and
City Council. Unfortunately, Staff did make an error in scheduling and the request for extension
was not reviewed by the Planning Commission on June 5. To allow Staff time to process the
extension request through the Planning Commission, City Council granted a temporary (21 day)
extension) to the conditional use permit on June 10, 2003. This item must be on the July 8 City
Council agenda for action; therefore, it is necessary that the Planning Commission review the
request and make a recommendation to City Council at the June 25 special Planning Commission
meeting.

Recommendation:

With respect to request for extension, City Staff will be prepared to make a verbal
recommendation at the June 25 meeting.

Commission Action:

Motion to recommend that City Council a resolution to approve/deny the request for extension to
comply with terms of conditional use permit issued to St. Paul Terminals.

Review Checklist:

City Admirdstrator
City Attorney
Principal Planner
Associate Planner

PC: 06/25/03

32
