CASE # <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXCEED ACCESSORY <br />BUILDING SIZE RESTRICTIONS; <br /> CASE OF DAVID AND SANDRA SHAPPELL <br /> By: Chris Anderson, Community Development Assistant <br /> <br />Background: <br /> <br />The City received an application from David and Sandra Shappell for a conditional use permit to <br />exceed the detached accessory, building size restrictions established in City Code on the property <br />located at 9325 164th Lane NW. <br /> <br />The following items are enclosed for your information: <br /> <br />a) Site location map <br />b) Site plan <br />c) Construction plan (two sheets) <br />d) Picture of property <br />e) Proposed findings of fact <br />f) Proposed conditional use permit <br />g) Proposed resolution denying the conditional use permit <br /> <br />Notification: <br /> <br />State statute requires notification of the public hearing to property owners within 350 feet of the <br />subject property. Staff sent out notices to all property owners within 350 feet. <br /> <br />Observations: <br /> <br />The subject property is approximately 2.43 acres in size and is located outside the Metropolitan <br />Urban Service Area (MUSA). Under City Code, parcels between 2-2.59 acres can have up to <br />2,064 square feet of accessory building space. The proposed building will be 1,700 square feet <br />(34' x 50') in size. Coupled with the existing garage (1,030 sq. ft.), the applicant will have 2,730 <br />sq. ft. in accessory buildings. This results in an overage of 666 square feet. The applicant would <br />like to exceed the 2,064 square feet restriction in order to construct a detached accessory building <br />that would accommodate the storage of a 5th wheel travel trailer as well as a tractor and other <br />personal equipment/vehicles. <br /> <br />The applicant has stated that the exterior wall materials will consist of finished coat stucco that <br />will match the house exterior. The accessory building will comply with the height restrictions. <br />The Applicant has stated that the detached accessory building will be utilized for personal <br />storage. <br /> <br />The proposed detached accessory building will be located in the rear yard to the northwest of the <br />principal dwelling. The proposed accessory building location exceeds the ten (10) foot side yard <br />and five (5) foot rear yard setbacks established in the Rural Developing Bulk Standards. There is <br />an existing driveway leading to the proposed site. The applicant stated that an approach would <br />be installed. <br /> <br /> <br />
