CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO <br />GRADE AND EXPORT SOILS; CASE OF ERIC THOMSEN <br />By: City Engineer Steve Jankowski <br /> <br />Background: <br /> <br />The City, has received an application from Eric Thomsen to gade and export soils from an area <br />generally located west of T.H. #47 and south of County Road ~-6.~, at about Vanadium Street <br />N.W. The subject property consists of 63 acres of wh/ch the proposed activity would be <br />confined to 9 acres. <br /> <br />The City Council originally approved a conditional use permit for g-fading and exporting of soil <br />from th/s property on March 25, 1997. The applicant did not initiate the condkional use permit <br />within this three-year timeframe. The applicant subsequently applied :for and received a new <br />conditional use permit to mine mater/al on May 23, 2000, which was to expire two years from the <br />date of commencement of the operation, but no later than three years from the date of issuance. <br />Material was mined for the T.H. 47 project in June 2000, and for additional uses thereafter. The <br />applicant desires to continue the mining and gading operation to completion of the original <br />proposal of nine acres; and has reapplied for a continuation of the mining and grading conditional <br />use permit. <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />g) <br />h) <br />i) <br />J) <br /> <br />Site location map <br />Letter dated January 14, 1997 describing operations and intentions <br />Narrative for Borrow Pit utilization <br />Grading Plan revised April 22, 2002 <br />Planning Commission meeting minutes dated February 4, 1997 <br />City Council meeting minutes dated March 25, 1997 <br />Plarming Commission meeting minutes dated May 2, 2000 <br />City Council meeting minutes dated May 23, 2000 <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />Notification: <br /> <br />Conditional Use Permits are required to be subjected to public hearings with all properties within <br />350 feet being notified of the public hearing. The Anoka County, Highway Department was also <br />notified of the conditional use permit application. <br /> <br />Observations: <br /> <br />At the present time roughly 70% percent of the proposed area of Phase I, or 30% of the entire <br />area has been excavated. The applicant has submitted a revised copy of the original site plans <br />showing the existing spot elevations in the excavated area. This submittal coupled with a site <br />visit leads start to conclude the site is in compliance with the conditions of the current permit, <br />however, restoration has yet to be initiated.
