CASE <br /> <br />REQUEST FOR A CONDITIONAL USE PERMIT TO EXPAND A <br />LAWFUL NONCONFORMING READY-MLX PLANT TO INCLUDE <br />A SECOND SILO; CASE OF MARSHALL CONCRETE <br /> By: Sylvia Frolik, Community Development Director <br /> <br />Background: <br /> <br />Marshall Concrete is a law-ful nonconforming concrete ready-mLx plant located at 14141 Unity <br />Street N.W. The company has determined that their operation is in need of a second product <br />silo. According to City Code, any enlargement or expansion of a lawf.d nonconforming use <br />must be done so in accordance with City Code. Therefore, Marshall Concrete has applied for a <br />conditional use permit for the addition of the second silo. The following items are enclosed for <br />your information: <br /> <br />a) <br />b) <br />c) <br />d) <br />e) <br /> <br />Site Location Map <br />Facility Elevations <br />Site Photos <br />Proposed Findings of Fact <br />Proposed Conditional Use Permit <br /> <br />Notifications: <br /> <br />State law requires notification of the request and public hearing to properties within 350 feet of <br />the boundaries of the subject property. <br /> <br />Observations: <br /> <br />It is reasonable to assume that the volume of traffic and activity will increase with the addition of <br />the second silo. The Public Works Department has. advised that the tracldng of dirt onto 140~' <br />Avenue from traffic entering and ex/ting the property is an issue that should be addressed. Also, <br />upon a site inspection it became apparent that the ex/sting berm and landscape screening adjacent <br />to 140m Avenue has significantly deteriorated. <br /> <br />The proposed silo will be 61 feet in height; the exiting silo is 62.5 feet in height. There is a 35 <br />foot structure height restriction in the Industrial District. Marshall Concrete has also applied for <br />a variance to the height restriction. <br /> <br />Recommendation: <br /> <br />City Staff is recommending approval of the addition of the second silo with the following <br />contingencies: <br /> <br /> <br />
