17) <br /> <br />Receipt of letter from Grayce Kalstad requesting inclusion of her property into the <br />Municipal Urban Service Area (MUSA) boundary. <br /> <br />18) <br /> <br />Resolution #89-11-318A approving final pay estimate to Ridgedale Electric for <br />Project #88-26 (revised traffic control system at T.H. #10 and Sunfish Lake Blvd. <br />N.W.). <br /> <br />COUNCIL BUSINESS <br /> <br />Case #1: <br /> <br />Request For A Conditional Use Permit To Operate A <br />Recreational Vehicle Sales Lot In The I-1 Industrial District; <br />Case Of Mark Manthei And Robert McElhaney, W.S. Motors: <br /> <br />Robert McElhaney and Mark Manthei were present. <br /> <br />Planning Assistant Frolik stated that W.S. Motors has applied for a conditional use permit <br />to operate a recreational vehicle sales lot in the I-1 Industrial District. The business would <br />be located at 14250 Sunfish Lake Blvd. N.W. and would share the existing building with <br />G.O. Racing. The Planning and Zoning Commission conducted a public hearing and <br />recommended approval of a conditional use permit for a 3 year time frame. The 3 year time <br />frame is a result of City Staffs concern with sewer and water coming to the area in the very <br />near future and R.V. sales not being the highest and best use of property served by <br />municipal services. <br /> <br />Mr. Goodrich noted that State Statute indicates that it is not appropriate to place a term on <br />conditional use permits and he would be concerned that in 3 years the applicant will not <br />want to voluntarily cease the operation. Mx'. Goodrich advised that if the City Council is <br />inclined to grant a conditional use permit with a time frame term, it should not be <br />considering granting it at all. Mr. Goodrich further explained that there is no specific law, <br />but it seems the only solid ground cities are on in limiting the term of conditional use <br />permits is when there is limited natural resource involved. <br /> <br />City Council proceeded to review the proposed findings of fact. <br /> <br />Councilmember DeLuca inquired if the retail sales operation will be allowed to have outside <br />storage because it is located in the Industrial District. <br /> <br />Mr. Hartley replied that both the property owner and the applicant would have to enter into <br />and comply with the conditional use permit; the proposed permit does not allow exterior <br />storage of inoperable vehicles, parts, tires or inventory. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Peterson to adopt <br />Findings of Fact g0265 relating to Robert IvlcElhaney and Mark Manthei's request for a <br />conditional use permit to operate a recreational vehicle sales lot at 14250 Sunfish Lake <br />Blvd. N.W. <br /> <br />City Council, City Staff and the applicants proceeded to review and discuss the proposed <br />conditional use permit. <br /> <br />City Council/November 28, 1989 <br /> Page 6 of 14 <br /> <br /> <br />
