Bev Semanko - Inquired if the City has to agree to what is proposed in the PUD <br />preliminary concepts if the rezoning to PUD is approved this evening. <br /> <br />Mark Banwart replied that if Council approves the PUD rezoning, they are only agreeing to <br />the concept of a PUD; the final PUD plat may not look anything like what is proposed at <br />this stage. <br /> <br />Bev Semanko - Noted that even though the sketches may change, there most likely will be <br />one acre lots. <br /> <br />Mark Banwart replied that there could be one acre lots if the soils meet the requirements for <br />on-site septic systems. <br /> <br />Case #8: Request To Rezone The Proposed Plat Of Trott <br /> From R.I Rural Residential To Planned Unit <br /> Case Of Gerald Bauer: <br /> <br />Brook Ponds <br />Development; <br /> <br />Mark Banwart stated that the proposed plat of Trot/Brook Ponds originally involved a 153 <br />acre tract of land. At the public hearing, a number of residents to the north of the subject <br />area expressed concern for their parcels being landlocked. Based on those comments, <br />Gerald Bauer has taken steps to acquire land to the north and include it in the Trott Brook <br />Ponds Addition. As a result of that action, a second public hearing is being scheduled by <br />the Planning and Zoning Commission to assure that all property owners within 350 feet of <br />the now new boundaries for Trott Brook Ponds have the opportunity for input into the <br />project. Mr. Banwart noted that the proposed plat involves more than 50 unsewered lots <br />and as such, will be required to perform an environmental review. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to adopt <br />Findings of Fact #0267 relating to Mr. Gerald Bauer's request to rezone the proposed plat <br />of Trott Brook Ponds from R-1 Rural Residential to Planned Unit Development. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to approve <br />Mr. Gerald Bauer's request to rezone the proposed plat of Trott Brook Ponds from R-1 <br />Rural Residential To Planned Unit Development. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Motion by Councilmember DeLuca and seconded by Councilmember Pearson to introduce <br />Ordinance #89-X rezoning the proposed plat of Trott Brook Ponds from R-1 Rural <br />Residential to Planned Unit Development. <br /> <br />Motion carried.
