Voting No: None. <br /> <br />Case #6: <br /> <br />Adopt Ordinance Rezoning The Proposed Plat Of Fleischer's <br />2nd Addition From R-3 Urban Residential And B-1 Business <br />To R-1 Urban Residential; Case Of Doloras Fieischer: <br /> <br />Mr. Banwart stated that on November 28, City Council introduced an ordinance to rezone <br />the proposed plat of Fleischer's 2nd Addition to R-1 Urban Residential and it is eligible for <br />adoption at this time. <br /> <br />Motion by Councilmember Peterson and seconded by Councilmember Pearson to adopt <br />Ordinance #89-30 rezoning the proposed plat of Fleischer's 2nd Addition to Ro 1 Urban <br />Residential. <br /> <br />Motion carried. Voting Yes: Mayor Reimann, Councilmembers DeLuca, Pearson, Cich <br />and Peterson. Voting No: None. <br /> <br />Case 87: Request To Rezone The Proposed Plat Of Tooth Acres <br /> Addition From I-1 Industrial To R-1 Rural Residential; Case <br /> Of James M. Martin: <br /> <br />Mr. Hartley recalled that this case was withdrawn from the agenda at the request of the <br />applicant. <br /> <br />MISCELLANEOUS ITEM <br /> <br />A. Resolution Affirming City Policy And Significance As To Rural Area <br /> PUD Approval <br /> <br />Mr. Goodrich presented, and reviewed in detail with the Council, a proposed resolution <br />affirming the City's policy for considering Planned Unit Developments (PUD). Mr. <br />Goodrich noted that if the Council grants PUD zoning, the City is obligated to approve the <br />PUD site plan. For purposes in reviewing the 4 PUD's on tonight's agenda, the terms <br />preliminary concept plan and preliminary site plan are interchangeable. Mr. Goodrich <br />noted that even if Council grants preliminary site plan to the 4 PUDs this evening, there is <br />still the opportunity to review many issues relating to the PUDs as they must still go <br />through preliminary plat and final plat processes. Tonight, Council will be considering <br />giving PUD blessing to the plats, but once that is done, the City is tied into the PUD <br />concept. Mr. Goodrich also noted that no matter what size lots are allowed in the PUDs, <br />they must still meet the requirement for adequate Class 1 soils to support on-site septic <br />systems. <br /> <br />Mr. Goodrich noted that if final plats are not accomplished 12 months from the time of <br />PUD rezoning, the City Council can initiate action to revert the zoning to what it was prior <br />to the PUD rezoning. <br /> <br />Mr. Hartley suggested that since PUD concept plans and zoning are linked so closely, that <br />City Council consider the rezoning and preliminary concept plans for each proposed PUD <br />respectively on tonight's agenda. <br /> <br />City Council/December 19, 1989 <br /> Page 8 of 22 <br /> <br /> <br />
