EXHIBIT G <br />Use Rectrietinf <br />For the purposes of this Exhibit F and the foregoing Agreement, the following terms shall have the <br />following meanings: <br />Quick Serve Restaurant" means a restaurant (with or without drive -through windows) where <br />customers order at a counter and either wait at the counter for their orders to be delivered or seat <br />themselves in the seating area after ordering at the counter and staff brings the order to the customers' <br />table but performs no other services ordinarily performed by restaurant waitstaff <br />Lot 5 Owner" means the owner_ from time to time of Lot 5. <br />"Restricted Menu" means hot beef (including hamburger) and/or hot chicken sandwiches as the <br />primary menu item served by the facility in question_ <br />Commencing_ on the Closing Date (as defined in the foregoing Agreement'_ so long as McDonalds is <br />operating a McDonalds restaurant/store on Lot 4_ the Lot 5 Owner will not cause or permit the use of Lot <br />5 or any part thereof as a Ouick Serve Restaurant serving the Restricted Menu. If at any time after the <br />Closing Date_ McDonalds is not operating a McDonalds restaurant store on Lot 4_ then there shall be no <br />restrictions on the ability of the Lot 5 Owner to use_ or allow the use of all or a portion of Lot 5 for any <br />lawful purpose_ including_ without limitation_ as a Ouick Serve Restaurant serving the Restricted Menu. <br />Nothing herein will prevent the Lot 5 Owner or any assignee or subtenant thereof from time to time from. <br />operating (a) a full service restaurant: that is_ a restaurant where customers seat themselves or are seated <br />by staff and have their orders taken at their tables with such orders served by waitstaff: and/or (b) a so- <br />called convenience store selling food items_ including without limitation_ cold sandwiches_ hot <br />sandwiches and pizza. <br />84959-004\ 1571749.doc <br />G-1 <br />
