CASE <br /> <br />ADOPTION <br /> <br />OF ORDINANCE TO VACATE DRAINAGE AND UTILITY EASEMENTS <br /> IN GATEWAY NORTH INDUSTRIAL PARK PLAT 2; <br /> CASE OF BASALT PROPERTIES <br /> By: PatrickTrudgeon, AICP <br /> Assistant Community Development Director <br /> <br />Background: <br /> <br />The City Council recently approved the site plan and final plat of Basalt Office park, a <br />redevelopment project along Basalt Ave., south of Bunker Lake Blvd. (CR 116). The plat <br />combined three platted lots into one lot. A result of that plat, new easements were created and <br />the standard drainage and utility easements'around the old lots are no longer needed. Therefore, <br />Basalt Properties is asking that these drainage and utility easements be vacated. ' <br /> <br />The following items are enclosed for your information: <br /> <br />a) <br />b) <br />c) <br />d) <br /> <br />Site location map <br />Exhibit of underlying easements to be vacated <br />Approved Final Plat of Basalt Office Park <br />Proposed ordinance <br /> <br />Notification: <br /> <br />In accordance with State Statute, City Staff attempted to notify property owners within 350 feet <br />of the subject property of the public hearing to vacate easements. <br /> <br />Observations: <br /> <br />The ordinance to vacate the drainage and utility easements was introduced on October 28, 2003. <br />Under the City Charter, the ordinance is now eligible for adoption. <br /> <br />Recommendation: <br /> <br />City Staff recommends adoption of the enclosed ordinance to vacate existing easement. <br /> <br />Council Action: <br /> <br />Motion to adopt Ordinance #03- to vacate the easement for drainage and utility easements on <br />Lots 2,3, and 4, Block 1, Gateway North Industrial Park Plat 2. <br /> <br />Review Checklist: <br /> <br />Asst.
